Agreement to terms

These Terms of Service ("Terms") govern your access to and use of Quetzal Technology websites, applications, and related services (collectively, the "Service") operated by Quetzal Technology ("Quetzal," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, do not use the Service.

The service

Quetzal Technology provides apps, websites, digital products, and related technology services. Some products may focus on personal reflection, productivity, automation, or other useful niches. Product-specific details may be shown in the relevant app or service description.

We may update, suspend, or discontinue features at any time. Beta or early-access features may be incomplete, change without notice, or be withdrawn.

Eligibility

You must be at least 16 years old to use the Service. By using Quetzal Technology, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

Accounts & security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@quetzaltechnology.com if you suspect unauthorized access.

You agree to provide accurate registration information and keep it up to date.

Plans, billing & trials

Some features may require a paid subscription. Prices, billing cycles, and included features are shown at checkout or on our pricing page. Free trials convert to paid plans unless canceled before the trial ends.

Payments are processed by third-party payment providers. Subscriptions renew automatically until canceled in your account settings or by contacting support. Refunds are handled according to the policy displayed at purchase, except where required by law.

AI outputs & professional advice disclaimer

Some Quetzal products may use machine learning to generate summaries, scores, suggestions, or other outputs. These outputs are for informational and educational purposes only. They are not professional, legal, financial, medical, mental health, crisis intervention, or other specialist advice.

Do not rely on the Service to diagnose, treat, prevent, or decide any high-stakes matter. If you are in crisis or need immediate help, contact emergency services or a qualified professional. We are not a healthcare provider and do not establish a clinician-patient relationship.

Your content

You retain ownership of content you submit, such as notes, entries, files, messages, or similar data. You grant Quetzal a limited, worldwide license to host, process, and display your content solely to operate and improve the Service, including improving AI-assisted features as described in our Privacy Notice.

You represent that you have the rights to submit your content and that it does not violate these Terms or applicable law.

Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes.
• Attempt to reverse engineer, scrape, or overload our systems.
• Upload malware or content that infringes others' intellectual property or privacy rights.
• Harass, abuse, or impersonate others.
• Resell or sublicense the Service without our written consent.

Intellectual property

The Service, including software, design, branding, logos, and documentation, is owned by Quetzal or its licensors and protected by intellectual property laws. These Terms do not grant you any right to our trademarks except limited use to identify us as the source of the Service.

Third-party services

The Service may link to or integrate with third-party tools (analytics, authentication, payments). Those services are governed by their own terms and privacy policies. We are not responsible for third-party conduct.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR COMPLETE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUETZAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Quetzal from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by nature should survive (disclaimers, liability limits, indemnity, governing law) will survive termination.

Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

Before filing a claim, you agree to contact us at support@quetzaltechnology.com to attempt informal resolution.

Changes to these terms

We may modify these Terms at any time. We will post the updated version with a new "Last updated" date. Continued use after changes become effective constitutes acceptance. For material changes, we may provide additional notice.
